Finding Space Off-Campus

Real Estate Leases

For all real estate leases, even apartments, your first point of contact should be the Real Estate Department. Real Estate will coordinate with Counsel and Risk Management, obtain necessary signatures, and return the documents to you.

Please don't have your dean or director sign real estate documents, including leases. Real estate transaction authority is controlled by the University's corporate by-laws.

Real Estate Tax Exemption

There are two tests to qualify for real estate tax exemption: exempt ownership and exempt use.  Both must be met.  So, even if Cornell owns the property, if it's not being used for educational purposes and properly reported, it will be taxable.

The Real Estate Department must request tax exemption every year on every piece of exempt land owned by Cornell, anywhere. If an exemption renewal is not filed, or if the renewal application is incorrect, the land could be taxed.

So that your department and college don't end up paying taxes on real estate, please report the following to us:

  • Construction (any new building or major renovation).
  • Changes in use (e.g.; if you let an employee use a Cornell-owned house or apartment, or let the neighboring farmer plow 30 acres that you are not going to use this year, or you let an outside organization use space in a building), even if no rent is charged.)

Acquiring Property

Only the Executive VP and CFO and the VP Alumni Affairs and Development have authority to accept real estate gifts.

Business Assistance

The Real Estate Department can assist you in getting a new technology-based or other small business up and running. Through our affiliation with Cornell's Office of Economic Development, the Cornell Business & Technology Park, TCAD, the Cayuga Venture Fund and the Cornell Research Foundation, we can help facilitate everything from space, to capital, to management.

Land Stewardship

The university owns all of Cornell's land. The land is assigned to the colleges and departments by the Provost for their use. This land stewardship assignment can change as the needs of the university change.

In some cases, the using unit bears the expense of maintenance, taxes (assessments), utilities, etc.

If you have property that you don't use, there may be someone else at Cornell who could use it. If no one at Cornell needs the land, for present or future needs, it is excess and can be sold.

Proceeds from land sales go to the fund which purchased the property, not to the last college to use the land. Restricted gifts and some specially designated natural areas are an exception.

Timbering

Warehouse Storage
